As the law firm explains, under Maryland law, the definition of marriage is a civil contract between two people, and a divorce is a legal ending of a marriage ordered by a court. In this state, there are two types of divorce cases: absolute divorce and limited divorce. The former is a permanent end to the marriage, and should the court grant an absolute divorce, the final order of the divorce is set for a ‘divorce’ decree. A limited divorce on the other hand acts as a legal separation and does not immediately end the marriage.
The statutory requirements a married couple must meet to obtain an absolute divorce or limited divorce are defined in Maryland Family Law Code § 7-103. There are seven grounds for absolute divorce as defined in the law, and they are twelve month separation, mutual consent, adultery, cruelty of treatment, desertion, insanity and incarceration. These grounds — and only these grounds — qualify a married couple for absolute divorce. Once a decree of absolute divorce is entered, either party may remarry.
A limited divorce (also known as legal separation) is a legal action where a married couple is separated. During this time, the couple remains legally married while living separate and apart from one another. If either spouse has sexual relations with another person during this period, it would count as adultery in the eyes of the court. Limited divorces are not a requirement in Maryland, but they do have some set grounds, which are separation, desertion, cruel treatment and excessively vicious conduct. A divorce attorney may recommend this route if the grounds for absolute divorce have not been met, either one of the couple is in need of financial relief, or they are unable to settle their difference privately.
